Kansas law limits punitive damages to either $5,000,000 or the defendants gross annual income whichever is lower.  If the defendants annual income is deemed to low to be an effective deterrent the courts can consider 50% of the defendant’s net assets instead of annual income.  Punitive damages are decided by the judge rather than the jury.

Kansas does not limit non-economic damages.
